Important: Please read these Official Rules before participating in the Sweepstakes. By participating in the Sweepstakes, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements below.

OFFICIAL RULES

Eligibility. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. The Sweepstakes is open only to legal residents of the 50 United States (and the District of Columbia) who are at least 18 years old (or the age of majority under applicable law). IF YOU DO NOT MEET ALL OF THESE REQUIREMENTS, OR ANY OTHER ELIGIBILITY REQUIREMENTS IN THESE OFFICIAL RULES, YOU ARE NOT ELIGIBLE TO WIN A PRIZE, AND PET360, INC. (BLOGPAWS) (“SPONSOR”) RESERVES THE RIGHT NOT TO AWARD PRIZES TO YOU. To be eligible to win a prize, entries must be completed and received by Sponsor in the manner and format designated in these Official Rules. Employees, directors and officers of Sponsor, PetSmart, Inc., PetSmart Charities, Inc., Banfield Pet Hospital (Medical Management International, Inc.) and any of their respective affiliates, parent companies, subsidiary companies, and advertising and promotion agencies (collectively, the “Sweepstakes Entities”), and members of their immediate families (spouses, parents, children, and siblings and their respective spouses, regardless of where they reside), and/or those living in the same household of each, are not eligible to participate or win any prizes. All applicable federal, state/provincial and local laws and regulations apply. By participating in the Sweepstakes, you agree that: (1) you have read and understand the Official Rules; (2) you meet the Sweepstakes eligibility requirements as explained in the Official Rules; (3) you are bound by the Official Rules and to Sponsor’s Conditions of Use, Legal Notices and Privacy Policy as published at www.blogpaws.com; (4) you unconditionally accept and agree to comply with and abide by the Official Rules and the decisions of Sponsor; and (5) the Official Rules shall be legally binding on you and your legal representatives, heirs, successors, and assigns.

Entry Period: All entries must be received between 12:00:00 a.m. ET February 21, 2017 and 11:59:59 p.m. ET March 6, 2017 (“Entry Period”).

How to Enter the Sweepstakes. Entrants can enter the Sweepstakes via their personal Twitter account. In order to obtain an Entry via Twitter, each Entrant must:

(a) be an authorized account holder of Twitter (Twitter membership is free, but is subject to acceptance of the Twitter Terms of Use, which can be found at https://twitter.com/tos);
(b) compose a tweet including the reason you feel that YOU must be at the BlogPaws 2017 Conference (the “Conference”) and include the hashtag #BPorBust17, which tweet must comply with the Twitter character limit (140 characters) and applicable file size limits; and
(c) post the tweet on Twitter during the Entry Period (resulting in one (1) Entry).

Only tweets with that hashtag will be counted. Please do not include links to pictures, blog posts or any other URL, in your tweets. We are looking for words only. Any tweets that do not follow these guidelines will not be counted as Entries.

Entries. Entrants may enter up to 14 times during the Entry Period with the same or with different Tweets, but no more than one (1) time within any given 24 hour period. Entries in excess of the permitted one (1) per entrant, per 24 hour period will be disqualified.
All entries must be in English. Any attempt by an entrant to post duplicate or near duplicate posts, will void such entrant’s entries and that entrant may be disqualified, and any potential prize will be forfeited. Entries generated through a third-party website or software or in any way other than the manner and format set forth in these Official Rules is prohibited, and Sponsor reserves the right to disqualify any such entrant(s).

Other Sweepstakes Submission Requirements: Any Entry will be disqualified that contains material that, in the sole discretion of Sponsor:

• Communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate. Examples include, pets in unsafe situations, or entries that promote bigotry or discrimination.
• Disparages any person, Pet360, BlogPaws, the Sweepstakes Entities or any such entity’s products.
• Violates or infringes upon the copyrights, trademarks, or privacy, property, publicity or other intellectual property rights of any person or entity not affiliated with this Sweepstakes;
• Contains any personal identification, such as personal names or e-mail addresses;
• Promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing);

Any Entry, in the sole opinion of Sponsor, is considered inappropriate or not suitable for publication under the Official Rules may be disqualified.

Sweepstakes Prizes. Three (3) prize packages will be awarded.

Grand Prize: One (1) all expenses paid trip to the Conference in Myrtle Beach, South Carolina at the Host Hotel consisting of airfare for one (1) person, three (3) nights lodging at the Host Hotel, and one (1) full blogger registration to the Conference (up to a maximum of $1,300.00). Winner will be required to book his or her own airfare and will be reimbursed by Sponsor. Lodging at the Host Hotel and registration for the Conference will be purchased by Sponsor and given to the winner.

First Place Prize: One (1) prize package consisting of three (3) nights lodging at the Host Hotel and one (1) full blogger registration to the Conference (approximate retail value $945.00). Lodging at the Host Hotel and registration for the Conference will be purchased by Sponsor and given to the winner.

Second Place Prize: One (1) full blogger registration for the Conference (approximate retail value: $229). Registration for the Conference will be purchased by Sponsor and given to the winner.

Sweepstakes prize winners must obey all local laws in regard to lodging restrictions, including all published pet policies. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to: food and beverage, airport transfers, car rental, room service, gratuities, personal charges at lodging, telecommunication charges, security fees, baggage fees, taxes and fees associated with the prize packages, or other expenses or incidentals are solely the responsibility of prize package winner.

Any and all costs, fees not expressly stated in the prize description are the sole responsibility of the Sweepstakes prize winner. Any difference between the approximate retail value and the actual value will not be awarded and any difference will not be refunded. Sponsor does not represent that any money provided as part of the Sweepstakes prize to help towards taxes will be sufficient to cover any winner’s potential tax liability associated with winning a prize. No insurance is provided as part of the prize, and obtaining any insurance, such as but not limited to travel insurance, health, accident or medical insurance, and property loss or damage insurance is the sole responsibility of the winner and/or winner’s guest(s) (if any). Travel and other arrangements will be determined by Sponsor (where applicable). Air travel will be round trip (originate from and end at the same airport) coach class from and to an airport selected by Sponsor. All rooms are subject to prior sale, so advanced reservations are required. All reservations must be made and tickets issued prior to travel. Tickets and certificates are non-refundable and non-transferable and are not redeemable for cash. Changes to reservations are not permitted. Prize winner is solely responsible for having any required travel-related documents (including valid government-issued photo ID and/or any required passport or visa) prior to departure as well as fulfilling any/all travel and security requirements. Sponsor reserves the right in their respective sole discretion to designate all flight/travel particulars and route or routes (as the case may be). Failure to complete the trip portion of the prize (or any portion of the prize) does not relieve the prize winner of their tax obligations associated with winning the trip prize. Flight schedules are subject to change without notice. In the event a winner lives within one hundred (100) miles of the destination for their prize, air travel will not be included in the trip prize and any such winner will be compensated a total of two hundred dollars ($200) in lieu of air travel, for any alternate travel expenses. No Released Party will be liable for any missed opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. If a winner (and/or the winner’s guest[s]) is not able to participate in any portion of a travel prize, that unused portion will not be substituted for cash or any other prize. Prize winners may be required to provide a current valid major credit card at time of hotel check-in to cover incidentals, and any and all costs, fees, and expenses not expressly stated in the prize description. Restrictions and/or blackout dates may apply to some trip prizes. Each winner (and each guest, if any) agrees to maintain their behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any prize-related activity. Prize winners understand and agree that Sponsor has the right, in their sole discretion, to disqualify and remove a prize winner and/or any guest from any activity at any time if that winner or guest’s behavior at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of Sponsor, or otherwise violates the policies of the Sponsor. The prize package winner is solely responsible for the behavior of winner’s guests. If any activity relating to the Sweepstakes prize is cancelled or postponed for any reason, the balance of that prize will be awarded in full satisfaction of the prize awarded.

The prize winner acknowledges and accepts all risk of damages, injury or other incidental loss, whether occurring before, during or after the conference, and hereby voluntarily agree to assume the same. The Sponsor reserves the right to refuse admission and/or to expel from the entire or any portion of the Conference and/or any other aspect of a prize, of any person whose conduct is deemed by them to be objectionable. Expulsion from the conference cancels the tickets for the offending individual(s) and the individual(s) thereupon forfeit(s) all claims with respect to the tickets and associated elements of the Sweepstakes prize.

The Sweepstakes prize must be accepted as awarded, without substitution, and is not transferrable, refundable, for resale or, where applicable, convertible to cash, except in the sole discretion of the Sponsor. The Sponsor reserves the right, in the event that a Sweepstakes prize, or any component of the Sweepstakes prize, cannot be awarded as described herein for any reason, to substitute the same for another prize or component of equal or greater value, without notice or liability. In the event that a substitute prize is awarded, such prize must be accepted as awarded and cannot be exchanged for cash (where applicable) or otherwise.

Odds of Winning a Sweepstakes Prize. Odds of winning the Sweepstakes prize depend on the number of entries received during the Entry Period.

Sweepstakes Winner Selection. One (1) potential Grand Prize winner, First Place winner and Second Place winner will be selected in a random drawing from among all eligible entries received during the Entry Period on or about March 7, 2017, for a total of three (3) winners. Sponsor will attempt to notify potential prize winners on or about March 7, 2017 via Direct Message to the potential winner.

Potential winners may be required to execute and return an Affidavit of Eligibility for verification purposes or Liability/Publicity Release (TN residents need not sign publicity release) within three (3) business days. In the event of noncompliance with these Official Rules; if Sweepstakes prize notification is returned as undeliverable; if the potential winner does not respond to Sponsor’s direct message within the Entry Period; or a Sweepstakes prize winner declines prize offered, the Sweepstakes prize will be forfeited and Sponsor may select an alternate winner by random drawing from among all remaining eligible Sweepstakes Entries received during the corresponding Entry Period. Sweepstakes prizes will be delivered within 6 – 12 weeks from date of verification via mail or freight to the street/mailing address provided by a winner in the Sweepstakes Application.

Sponsor’s License to Entries. Each entrant grants to Sponsor, and its successors, assigns, licensees, representatives, agents, and those acting at Sponsor’s direction, a perpetual, irrevocable, royalty-free, non-exclusive, worldwide right and license to publish, reproduce, display, perform, distribute, adapt, edit, modify, translate, create derivative works based upon, and otherwise use and sublicense your Entry, or any portion thereof, in any manner, form, media or technology now known or later developed for any commercial or non-commercial purpose without your notice, review, or approval. Each entrant waives its moral rights, in the Entry, in favor of the Sponsor, and its successors, assigns, licensees, representatives, agents, and those acting at Sponsor’s direction. Each entrant agrees to take, at Sponsor’s expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect or confirm Sponsor’s rights as set forth above in this paragraph. Sponsor does not guarantee that all submitted Entries will be published.

As a condition of submitting an Entry, each entrant acknowledges and agrees that (a) Sponsor and other participants have access to and/or may create or have created entries and/or other materials, ideas and concepts which may be similar or identical to the entrant’s Entry in theme, idea, format, characters and/or other respects; (b) the entrant will not be entitled to any compensation or other consideration because of the use by Sponsor or any other participant of any such similar or identical material, ideas and/or concepts; and (c) Sponsor’s or another participant’s use of material containing elements similar to or identical with those contained in the entrant’s Entry shall not obligate Sponsor to negotiate with and shall not entitle entrant to any compensation or other claim.

Disclaimer. Sponsor, the Sweepstakes Entities, and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees, media partners, printers, and agencies (collectively, the “Released Parties”) will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related or technical malfunctions or failures; (c) any Sweepstakes disruptions, injuries, losses or damages caused by events beyond the control of Sponsor or by non-authorized human intervention; (d) damage caused by computer virus or otherwise resulting to any computer from entrant’s participation in the Sweepstakes or access of the any websites related to the Sweepstakes, whether human, mechanical or electronic; (e) any printing or typographical errors in any materials associated with the Sweepstakes; or (f) incorrect or inaccurate information, whether caused by Internet users or by any of the programming or equipment associated with or used in the Sweepstakes.

ALL FEDERAL, STATE/PROVINCIAL AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. All prizes will be awarded. Prize notifications returned as undeliverable or otherwise not claimed within five (5) business days after delivery will be forfeited and will be awarded to an alternate winner. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Limit one (1) prize per person, household or address. All prizes are awarded “AS IS” and WITHOUT EXPRESS OR IMPLIED WARRANTY OR CONDITION OF ANY KIND (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Sponsor is not responsible for loss, delay or damage in shipping any prize or notification.

Identity of Entrant. In the event of a dispute over the identity of an online entrant, Entry will be deemed submitted by the authorized account holder of the e-mail account of the e-mail address submitted at time of Entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted e-mail address. A potential prize winner may be required to provide Sponsor with proof that the potential prize winner is the Authorized Account Holder of the e-mail address associated with the winning Entry.

General Release. By entering this Sweepstakes, you release Sponsor, and all Released Parties, from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or delivery, misdelivery, acceptance, possession, use of, misuse of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to intellectual property, personal injuries, death, damage to or destruction of property (including your pet), rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

Use of Entrant Name, Likeness, etc. Except where prohibited by law, by submitting an Entry, you hereby consent to Sponsor’s use of the Entry in its internal communications and publications and on social media and other marketing platforms. You also confirm that any people and/or the owners of any animals who are featured in the Entry gave permission for you to take the image(s) and do not object to your and Sponsor’s use of the same for commercial purposes.
